Terms of Service
Overview
These Terms of Service (“Terms”) govern your use of the AYIO Jobs platform at https://ayiojobs.com.au and all related services operated by AYIO Financial PTY LTD (ABN 41 670 505 816) (“we”, “us”, “our”). These Terms are effective from the date they are published on the Platform.
By accessing or using AYIO Jobs you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. These Terms form a legally binding agreement between you and AYIO Financial PTY LTD. If you do not agree, please do not register or use our Platform.
We may update these Terms from time to time. We will provide at least 30 days’ written notice of material changes via email to the address associated with your account. Your continued use of the Platform after the notice period constitutes acceptance of the updated Terms. If you do not agree with the changes, you may close your account before the changes take effect.
1. Definitions
“Platform” means the AYIO Jobs website at https://ayiojobs.com.au including all pages, features, and functionality. “User” means any person who accesses or uses the Platform, whether registered or unregistered. “Candidate” means an individual seeking employment through our Platform. “Employer” means a business or individual posting job opportunities. “Content” means any information, text, images, documents, or data submitted to or displayed on the Platform. “Services” means all features and functionality provided by AYIO Jobs. “Subscription Plan” means a paid tier providing Employers with access to premium features. “AI Features” means AI-powered tools including AI Job Writer, AI Candidate Scoring, AI Resume Builder, and AI Resume Parsing. “Personal Information” has the meaning given under applicable Australian privacy legislation.
2. Eligibility
To use AYIO Jobs you must be at least 18 years of age; be legally permitted to work in Australia if registering as a Candidate; have authority to bind your organisation if registering as an Employer; provide accurate and complete registration information; and not have been previously banned from the Platform. AYIO Jobs is designed for the Australian transport and logistics industry.
3. Account Registration & Security
When you create an account you agree to provide truthful and complete information, keep your login credentials confidential and not share them with any other person, accept responsibility for all activities that occur under your account, and notify us immediately of any unauthorised access or security breach. You must not create multiple accounts for the same person or entity.
You are entirely responsible for all losses resulting from failure to maintain the confidentiality of your credentials. We reserve the right to suspend or terminate accounts where we reasonably believe there is a security risk, misuse, or a breach of these Terms.
Login Verification
All accounts are protected with email-based login verification. Each time you sign in, a verification code is sent to your registered email address. You must enter this code to complete the sign-in process. Verification codes are strictly single-use and valid for a limited time.
You are responsible for maintaining access to your registered email address and keeping your email account secure.
AYIO Financial PTY LTD is not responsible for account lockouts resulting from loss of access to your email account, failure to maintain a valid email address, or any other inability to receive verification codes. If you are locked out you may contact support@ayiojobs.com.au for identity verification and account recovery, however recovery is not guaranteed and may require additional proof of identity at our sole discretion.
Cross-Membership with AYIO Marketplace
When you register on AYIO Jobs, a dormant account is provisioned for you on AYIO Marketplace (marketplace.ayiojobs.com.au), our vehicle and equipment marketplace. This dormant account cannot be logged into until you activate it, does not share your data with AYIO Marketplace until activation, and is activated only when you click the activation link in the welcome email. Activation is entirely optional and free. You may request deletion of your dormant AYIO Marketplace account at any time by contacting support@ayiojobs.com.au.
4. Permitted Use
We grant you a limited, non-exclusive, terminable right to access and use the Platform only for your personal hiring or employment purposes. The Platform is designed for individual human use. Except where we have provided a specific technical interface such as an API, you must not use or assist anyone to use any automated process, script, tool, bot, scraper, or other technical means to access, query, copy, collect, or extract information from the Platform without our prior written consent.
We may use technical measures including rate limiting, traffic shaping, and device fingerprinting to detect and prevent automated access and scraping. Circumventing these measures is prohibited and will result in immediate suspension or termination.
5. Candidate Obligations
As a Candidate you agree to provide accurate information about your qualifications, experience, and licences; hold valid licences and certifications as claimed; not misrepresent your work history or skills; apply only for positions you are genuinely interested in and qualified for; respond professionally to employer communications; keep your profile current; and not use the Platform to harass others or for any purpose unrelated to seeking employment. You must not post a profile or apply for a job on behalf of another person.
Providing false licence information may result in permanent account suspension and may be reported to relevant authorities. You are solely responsible for the consequences of your account use. We reserve the right to delete accounts after a significant period of inactivity.
6. Employer Obligations
As an Employer you agree to post only legitimate job opportunities with accurate descriptions and compensation details, comply with all applicable Australian employment laws including the Fair Work Act 2009 (Cth) and National Employment Standards, and not discriminate against candidates based on any protected characteristic under applicable Australian anti-discrimination legislation.
Employer accounts require a valid ABN verified through the Australian Business Register. Accounts with invalid or deregistered ABNs may be suspended. You must not use candidate information for purposes other than legitimate recruitment, must comply with all applicable privacy laws when handling candidate data, and are solely responsible for conducting your own background and reference checks.
Employers must not post job listings that contain discriminatory language, requirements, or preferences relating to race, colour, sex, sexual orientation, age, physical or mental disability, marital status, family or carer responsibilities, pregnancy, religion, political opinion, national extraction, or social origin, in accordance with the Fair Work Act 2009 (Cth) and applicable Commonwealth and state anti-discrimination legislation. AYIO Financial PTY LTD reserves the right to remove any listing that it reasonably considers contains discriminatory content, without notice or refund.
Employers must not post listings that misrepresent an employment relationship as an independent contractor arrangement. Job listings must accurately reflect the legal nature of the engagement. Listings that describe arrangements where an employer controls the work, hours, equipment, and method of performance as “contractor” roles may constitute sham contracting under sections 357–359 of the Fair Work Act 2009 (Cth) and are prohibited on this platform. Employers who select “Owner Driver,” “Subcontractor,” or “Contract” as the employment type must have obtained independent legal advice confirming the arrangement is a genuine contractor relationship.
7. Prohibited Activities
You must not use the Platform to:
- Post false, misleading, fraudulent, or discriminatory content
- Impersonate any person or misrepresent your identity or affiliations
- Post a profile, resume, or application on behalf of another party
- Solicit login credentials from other users
- Delete or alter content posted by any other person
- Harvest, scrape, or collect user information or contact details without consent
- Use automated tools, bots, or scripts to access or extract data without prior written consent
- Use any profile or candidate data to build, train, or improve machine learning or AI models
- Combine Platform data with other data to infer or discriminate on protected attributes
- Contact users who have requested not to be contacted, or send unsolicited commercial communications
- Interfere with the Platform’s security or attempt to gain unauthorised access
- Introduce viruses, malware, or other harmful code
- Post AI-generated or manipulated content that materially misleads or harms others
- Engage in sham contracting or misclassification of employees as independent contractors
- Reverse engineer or decompile any part of the Platform
- Resell, redistribute, or sublicense access to the Platform
- Engage in any unlawful activity through the Platform
8. Job Listings, Vehicle Listings & Content
All job listings must represent genuine, currently available opportunities, include accurate information, and comply with Australian employment and anti-discrimination law. Listings are published upon submission and are subject to ongoing review. We reserve the right to remove, suspend, or reject any listing or content at our sole discretion at any time, including after publication.
By submitting content to the Platform, you confirm you have the necessary rights for that content and grant AYIO Financial PTY LTD a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, reproduce, and distribute your content as necessary to operate the Platform. You retain ownership of your content.
Vehicle & Equipment Listings
Jobs may include vehicle and equipment details describing the employer’s actual assets. Vehicle and equipment descriptions must be accurate and not misleading, including details such as make, model, year, condition, registration, and pricing.
AYIO Marketplace Vehicle Opt-In
When posting a job with a vehicle or equipment listing, employers may opt in (via a separate checkbox) to have that vehicle listed on the AYIO Marketplace (marketplace.ayiojobs.com.au). By opting in, the vehicle listing data is pushed to AYIO Marketplace for display on the marketplace, the listing is subject to the AYIO Marketplace Terms of Use and advertising/listing fees (documented separately on marketplace.ayiojobs.com.au). AYIO operates an advertising platform only — AYIO does not act as a broker, does not charge commission on vehicle sales, and is not a party to any transaction between buyer and seller. This opt-in is entirely voluntary. You may withdraw a vehicle listing from AYIO Marketplace at any time.
9. Applications & Hiring
AYIO Jobs facilitates connections between Candidates and Employers but is not a party to any employment relationship. Submitting an application does not guarantee an interview, offer, or employment. Posting a job does not guarantee applications from qualified candidates.
Any employment agreement is solely between the Candidate and Employer. AYIO Jobs bears no responsibility for the terms, conditions, or outcomes of any employment relationship. Employment contracts formed through the Platform must comply with all applicable Australian employment legislation.
10. Subscription Plans & Payments
AYIO Jobs is completely free for Candidates. Job search, applications, profile creation, and messaging are available at no cost.
AYIO Jobs offers the following paid plans for Employers (AUD excluding 10% GST): Starter at $299/month for 1 job slot (30-day free trial available); Growth at $799/month for 3 job slots; Business at $1,499/month for 5 job slots and 1 featured slot; Enterprise at $2,999/month for 10 job slots and 3 featured slots. Add-on job slots are available at $85/month each; add-on featured slots at $299/month each.
All plans include access to candidate applications and messaging, AI features, bulk actions, and CSV export. Fees are billed monthly in advance and auto-renew unless cancelled. You may upgrade at any time; downgrades take effect at period end. You may cancel any time via your Dashboard.
Subscription pricing may be updated from time to time. We will notify you of any price changes prior to your next billing cycle. Continued use of the Platform after a price change takes effect constitutes acceptance of the new pricing.
Except as required by applicable law, all fees paid are non-refundable. Nothing in these Terms excludes any consumer guarantee conferred by the Australian Consumer Law that cannot be excluded by agreement.
11. Messaging
The Platform messaging system is available to Employers with an active paid plan to initiate contact with candidates who have applied. Candidates may reply at no cost. Free tier Employers cannot initiate messages. When a plan expires, active conversations close and message history becomes read-only.
You must communicate professionally and not use messaging for spam, harassment, or purposes unrelated to employment. Messages may be retained for compliance and dispute resolution and may be reviewed if a complaint is filed or a breach suspected.
12. AI-Powered Features
AI analysis is provided as a tool to assist decision-making only. Employers must conduct their own independent assessment of candidates. AI scores do not constitute automated decision-making that produces legal effects, and employers retain full responsibility for all hiring decisions. AI-generated content may contain errors; users are responsible for reviewing and verifying all AI-generated content before use.
In accordance with applicable Australian privacy legislation, we disclose that AI features process personal information to generate match scores and recommendations. You may request human review of any AI-generated assessment by contacting support@ayiojobs.com.au. AI features are powered by a US-based provider; relevant profile data is transmitted to servers in the United States and other jurisdictions when you use these features. By using AI features, you expressly consent to this cross-border transfer and acknowledge that we are not liable for the handling of your data by these third-party providers.
13. Intellectual Property
The Platform and its original content, features, and functionality are the property of AYIO Financial PTY LTD and are protected by applicable Australian and international intellectual property laws. The AYIO Jobs name, logo, and branding are trademarks of AYIO Financial PTY LTD. You may not use our trademarks or reproduce, modify, copy, or use Platform materials for commercial purposes without prior written consent.
14. AYIO Ecosystem
AYIO Jobs is part of the AYIO ecosystem, a group of connected platforms operated by AYIO Financial PTY LTD: AYIO Financial (ayiofinancial.com.au) for financial services, AYIO Marketplace (marketplace.ayiojobs.com.au) for vehicle and equipment sales, and AYIO Jobs (https://ayiojobs.com.au) as an employment advertising platform. AYIO Jobs is not a recruitment agency or labour-hire provider and does not place candidates with employers. Cross-platform data sharing only occurs with your explicit consent. Registering on AYIO Jobs provisions a dormant AYIO Marketplace account with no data shared until you activate it. Vehicle listing opt-in on job postings is a separate, voluntary action governed by the AYIO Marketplace Terms of Use.
15. Third-Party Services
The Platform integrates with third-party services including Stripe (payment processing), the Australian Business Register (ABN verification), AI service providers (AI-powered features), and AYIO Marketplace (vehicle marketplace). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services or the content of linked third-party websites.
16. Account Suspension & Termination
We may terminate or suspend your account immediately without prior notice for breach of these Terms, unlawful conduct, or where we reasonably believe your use poses a security or operational risk. Upon termination your right to use the Platform ceases immediately and any outstanding fees remain payable. Provisions capable of surviving termination remain in effect.
You may close your account at any time through your account settings or by contacting support@ayiojobs.com.au. Personal data will be handled in accordance with our Privacy Policy.
When an employer account is closed (whether by the employer or by us), candidate personal information that was accessed through that employer account will no longer be available to the employer. Candidate profiles, applications, and resumes remain on the Platform and accessible to other employers with active accounts. Candidates may request deletion of their data at any time in accordance with our Privacy Policy.
17. Disclaimer of Warranties
AYIO Jobs is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Platform will be uninterrupted, secure, or error-free; the accuracy of job listings, profiles, or AI-generated content; that you will find employment or suitable candidates; or the conduct or qualifications of any user. Other users’ information may be inaccurate, harmful, or offensive. You use the Platform at your own risk.
18. Limitation of Liability
To the maximum extent permitted by Australian law, AYIO Financial PTY LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total aggregate liability for all claims shall not exceed the total fees paid by you in the twelve months preceding the claim.
We are not responsible for employment decisions or outcomes, actions of any user, equipment transactions, loss of income or business opportunities, or decisions based on AI-generated content. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian consumer law.
19. Indemnification
You agree to indemnify, defend, and hold harmless AYIO Financial PTY LTD, its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform or violation of these Terms, content you submit, your violation of any law or third-party rights, or any dispute between you and another user.
18A. Dispute Resolution
If a dispute arises between you and AYIO Financial PTY LTD in connection with these Terms or the Platform, the parties agree to first attempt to resolve the dispute by good faith negotiation. If the dispute is not resolved within 30 days, either party may refer the matter to mediation administered by the Australian Disputes Centre (ADC) in Melbourne, Victoria. The costs of mediation will be shared equally between the parties. Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction.
20. Governing Law & Dispute Resolution
These Terms are governed by the laws of Australia, including the laws of all states and territories and all applicable Commonwealth legislation. The parties submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia. Nothing limits either party’s right to seek urgent interlocutory relief in any court.
You agree that any dispute must be brought in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
21. International Users
AYIO Jobs is operated from Australia and is intended primarily for Australian users. By accessing the Platform from outside Australia, you acknowledge that: (a) your personal information will be transferred to and processed in Australia; (b) Australian law governs your use of the Platform; and (c) you are solely responsible for ensuring your use complies with all applicable laws in your jurisdiction.
We make no representation that the Platform, its content, or the employment opportunities listed comply with the laws of any jurisdiction outside Australia. Job listings are primarily for roles in Australia. If you are located outside Australia, any employment opportunities accessed through the Platform are subject to Australian employment law and the applicable laws of the state or territory where the role is located.
We are not liable for your failure to comply with laws applicable in your jurisdiction.
By accessing the Platform from outside Australia, you agree that your use is governed by Australian law, and you waive any claims that might otherwise arise under the laws of your local jurisdiction. However, you acknowledge that enforcing foreign judgments against an Australian company may be subject to the limitations of Australian and international private law.
22. General
These Terms, together with our Privacy Policy and any applicable plan terms, constitute the entire agreement between you and AYIO Financial PTY LTD. If any provision is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision does not constitute a waiver. You may not assign your rights under these Terms without our written consent. We shall not be liable for delay or failure due to circumstances beyond our reasonable control.
