AYIO Financial PTY LTD (ABN 41 670 505 816) (“we”, “us”, “our”) operates the AYIO Jobs platform at https://ayiojobs.com.au (“Platform”).
We believe it is important that you understand how your information is collected, used and protected. This Privacy Policy applies to all users of the Platform, whether registered or unregistered, and covers all personal information collected through the Platform, our services, and any other engagement with us. By registering, creating an account, or continuing to use our Platform in any way, you explicitly consent to the collection, use and disclosure of your personal information as set out in this Privacy Policy.
1. Who We Are
AYIO Financial PTY LTD is responsible for the personal information collected through the AYIO Jobs platform.
We comply with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), the Privacy and other applicable Australian data legislation.
2. Information We Collect
Candidates: We collect account information including your name, email address, password, contact and location details; work rights, professional information, work preferences, uploaded documents (such as resumes), and consent records.
Employers: We collect account and contact information; business details (ABN and trading name; business location); operational details; uploaded content (logos and job listings); and payment records.
All Users: We automatically collect IP address, browser types, device identifiers, and usage data to operate, secure, and improve the Platform.
Sensitive Information: We may collect sensitive information where necessary (e.g., police check, status, medical certificates and visa status). By providing this information, you explicitly consent to its collection and use for the purpose of facilitating our services.
3. How We Collect Information
We collect personal information directly from you when you interact with the Platform, post or apply for a job, or contact us. We also collect information from third parties (e.g., the Australian Business Register). We collect information automatically through session cookies and server logs.
4. How We Use Your Information
We use your personal information to manage your account, match candidates with opportunities, process payments, provide customer support, and comply with legal obligations.
We also use your information to operate AI-powered features and improve the Platform, to detect fraud, and to send marketing communications.
5. Automated Processing & AI Features
In accordance with Australian privacy legislation, we provide transparency regarding our use of automated processing. AYIO Jobs uses artificial intelligence for features including: AI Job Writer, AI Candidate Scoring, AI Resume Builder, and AI Resume Parsing.
Relevant profile data is transmitted to our AI service providers. By using these features, you consent to this processing.
We utilize AI to streamline the recruitment process; however, final employment decisions remain at the discretion of the respective employers. We are not liable for any employment outcomes resulting from AI assessments.
Automated decision-making disclosure
AYIO Jobs uses automated tools to assist with matching candidates to job listings. Specifically:
- Candidate profile information including resume content, licence class, years of experience, location, employment history, and stated preferences is processed by an AI system to generate a match score.
- This score is displayed to employers as a percentage guide to candidate suitability for a listed role.
- The score assists employers in reviewing applications but does not automatically accept or reject any application.
- All final hiring decisions are made by the employer, not by the platform or its automated systems.
- Candidates may request human review of any automated assessment by contacting support@ayiojobs.com.au.
This disclosure satisfies our obligations under Australian Privacy Principle 1.7 (automated decision-making). The system described above does not make decisions that produce legal effects on individuals; final hiring decisions rest with employers, and candidates have an explicit right to human review at any time via the support address shown above.
6. Disclosure of Your Information
We disclose your personal information to other Platform users where necessary (e.g., sharing your profile with employers upon application). We disclose information to trusted service providers (including Stripe and AI providers), government agencies where required, and in connection with a business merger, acquisition, or sale.
7. Cross-Platform Data (AYIO Ecosystem)
AYIO Jobs is part of the AYIO ecosystem. When you register on AYIO Jobs, a dormant account is provisioned for you on AYIO Marketplace. Data is only shared with AYIO Marketplace if you explicitly activate the account. You may request the deletion of your dormant account at any time.
8. Cross-Border Data Transfers
Personal information is transferred to and processed by third-party service providers located outside Australia, including the United States and Germany.
By using our Platform and services, you consent to the disclosure of your personal information to overseas recipients as described below. We take reasonable steps to ensure that overseas recipients handle your personal information in a manner consistent with the Australian Privacy Principles, including through contractual arrangements and due diligence on their data handling practices. However, you acknowledge that overseas recipients may not be subject to the Privacy Act 1988 (Cth) and that different privacy standards may apply in their jurisdictions.
Specific overseas recipients
Personal information may be disclosed to the following categories of overseas recipients:
- AI processing services — Candidate profile data, resume content, and job listing information is processed by Groq Inc. (United States) for the purpose of candidate matching, job description generation, and resume analysis.
- Payment processing — Employer payment and billing information is processed by Stripe Inc. (United States) for subscription management and payment processing.
- Authentication services — Where Google Sign-In is used, authentication data is processed by Google LLC (United States).
- Analytics — De-identified usage data is processed by Google LLC (United States) for website analytics.
- Email delivery — Transactional emails are delivered via ZeptoMail (Zoho Corporation, Sydney, Australia). Bounce and complaint metadata is retained by ZeptoMail for sender-reputation monitoring.
- Geocoding — Approximate location queries (suburb/postcode to coordinates) are processed by Komoot GmbH via the Photon geocoding API (Germany).
Australian third-party services
The following Australian services receive limited personal or business information in the course of operating the Platform:
- Australian Business Register (ABR) — ABN and trading name lookups are performed against the ABR to verify employer business details.
- DigitalOcean (Sydney, Australia) — Our platform is hosted in the DigitalOcean SYD1 region. ZeptoMail (Zoho, Sydney, Australia) — Transactional email delivery. Google Analytics 4 (United States) — Aggregate usage analytics, loaded only after you accept the cookie banner.
AYIO Financial PTY LTD takes reasonable steps to ensure that overseas recipients handle personal information in a manner consistent with the Australian Privacy Principles, including by entering into contractual arrangements that require compliance with applicable data protection standards.
Where your information has been shared with a third-party provider, we cannot guarantee its complete removal from their systems following a deletion request.
9. Data Security
We implement technical and organisational measures to protect your information. However, no method or internet transmission is entirely secure.
To the maximum extent permitted by law, we expressly disclaim all liability for any unauthorised access, data breaches, or unlawful interception of your information by third parties.
Notifiable Data Breaches
In the event of an eligible data breach as defined under Part IIIC of the Privacy Act 1988 (Cth), AYIO Financial PTY LTD will comply with the Notifiable Data Breaches (NDB) scheme. This includes assessing suspected breaches, notifying affected individuals, and reporting eligible breaches to the Office of the Australian Information Commissioner as required.
10. Data Retention
We retain your personal information for as long as necessary to provide our services and comply with legal obligations. When you request deletion of your account, we will take steps to permanently de-identify or destroy your data within a reasonable timeframe, subject to our operational capabilities and statutory retention requirements (e.g., 7 years for financial records).
11. Your Rights
Under the Privacy Act 1988 (Cth) and the APPs you have the right to request access to and correction of the personal information we hold about you. To exercise these rights, contact us at support@ayiojobs.com.au. We reserve the right to verify your identity and may charge a reasonable fee for providing access, as permitted by law.
Right to deletion
You may request deletion of your personal information at any time by contacting privacy@ayiojobs.com.au. We will take reasonable steps to delete or permanently de-identify your information, subject to any legal obligations to retain certain records (such as financial transaction records required to be kept for 7 years under Australian tax law). Where your information has been shared with third-party service providers, we will request its deletion but cannot guarantee complete removal from their systems.
12. Marketing Communications
We may send you platform updates and promotional communications. You can opt out at any time by using the unsubscribe link in our emails or contacting support@ayiojobs.com.au.
13. International Users
AYIO Jobs is operated from Australia and is primarily for use in Australia. By accessing the Platform from outside Australia, you acknowledge that your data will be transferred to Australia and governed exclusively by Australian law. We make no representation that the Platform complies with privacy law of any other jurisdiction. To the maximum extent permitted by law, Australian law will govern any privacy dispute.
14. Changes to This Policy
We reserve the right to update this Privacy Policy at our sole discretion. Continued use of the Platform after any modifications constitutes your explicit acceptance of the updated Policy.
